How are divisions of property handled?

2. In New York - property is also divided under the principle of equitable distribution. The court will consider various factors such as the income and property of each party, the length of the marriage, and the contributions of each party to the marriage and to the acquisition of property.
3. In California - the courts use a system of community property to divide property in a divorce. Under this system, all property acquired during the marriage is considered to be jointly owned by both parties, and will be divided equally in a divorce.
4. In Texas - the courts use the principle of community property in dividing property in divorce. All property acquired during the marriage is considered community property and will be divided equally between the parties. However, separate property which is not acquired during the marriage will remain the property of the party who owns it.
